Basic Guide to Dismissal

January 1, 2026
This article explains the legal aspects of dismissal and its basic process in Japan. It covers what counts as a valid reason for dismissal and the required procedures an employer must follow.

**What is Dismissal?**

Dismissal is when an employer ends the employment contract with a worker. In Japan, an employer must have a legitimate reason to dismiss a worker.

**Valid Reasons for Dismissal**

Examples of valid reasons include serious violations of workplace rules or consistently poor performance. Dismissing a worker without a proper reason is prohibited by law.

**Dismissal Notice Procedure**

When dismissing a worker, the employer must give at least 30 days' advance notice. If the dismissal is effective immediately, the employer must pay a notice allowance in lieu of that notice period.
